How I Reported Shadowy BID Consultant Tara Devine To The City Ethics Commission For Failing To Register As A Lobbyist Based On Her Work For The Venice Beach Property Owners Association

The TL;DR is that I believe that in the course of her consultancy with the Venice Beach BID, Tara Devine qualified as a lobbyist within the meaning of the Los Angeles Municipal Lobbying Ordinance, was therefore required to register with the Ethics Commission, and failed to do so, putting her in violation of the law. If you know what all those terms mean, you may want to go straight to the complaint (Warning: 23MB PDF). For a detailed explanation of the background, though, read on!

The key is found in Section 48.07, which states that “An individual who qualifies as a lobbyist shall register with the City Ethics Commission within 10 days after the end of the calendar month in which the individual qualifies as a lobbyist.” After all, anyone can search the Ethics Commission’s database and see that Tara Devine has never registered as a lobbyist. So the question is whether Tara Devine is “An individual who qualifies as a lobbyist.” This turns out to be a fairly complicated thing to determine.

The first place to start when interpreting any law is with the definitions. In the case of the Municipal Lobbying Ordinance (henceforth “MLO”) they are found at LAMC §48.02. In particular, we will find that the word “lobbyist”:

means any individual who is compensated to spend 30 or more hours in any consecutive three-month period engaged in lobbying activities which include at least one direct communication with a City official or employee, conducted either personally or through agents, for the purpose of attempting to influence municipal legislation on behalf of any person.

And in order to see whether this applies to Tara Devine, we need to understand the following terms:

  • Lobbying activities
  • Municipal legislation
  • Attempting to influence


And once we understand what those three phrases mean, we have to show that Tara Devine was paid for 30 or more hours lobbying on behalf of someone else. The details, as always, are after the break!

New Documents: Central City East Association Tax Returns 2012-2015, Westchester Town Center BID Agendas and Minutes

Once and future queen of the Central City East Association, Ms. Estela Lopez herself yammering on about something to someone.
I have a couple new sets of documents to announce tonight. First there are tax returns from the Central City East Association from 2014 and 2015, and you can get them:

There’s a little puzzle hidden away in the two new ones. If you can spot it, drop me a line before I write a post on it1 and win a prize! I won’t approve any comments that give it away, though. No spoilers!

Also, in the face of the incredible, probably illegal, intransigence displayed by CD11 Councilmember Mike Bonin and his weirdo staff with respect to CPRA requests, I am making requests of the BIDs in CD11 for emails to/from lacity.org. Most of these are likely to be with Bonin or his staff, which will let us keep track of what’s going on in the District Office even if CD11 just actually won’t answer CPRA requests at all. It might be interesting, it might be useful, but there’s no way to know until we get the goods. The very first installment of this material comes from the Westchester Town Center BID, specifically from its Executive Director Donald Duckworth.2 Just tonight he handed over minutes and agendas from 2016, with a promise of a lot of emails to follow. For now this is only available on Archive.Org.

Do You Have What It Takes To Be A BID Consultant For The City Of Los Angeles? Honesty? Integrity? Freaking LIKEABILITY?!??!

If you follow BIDs in Los Angeles you will know that the process for creating a new one is so fraught with weirdo technicalities that when a Councilmember wants to form one in their district, not only do they have to get together a bullshit astroturf front group made up of major campaign contributors, but they also have to hire a consultant to guide the BAFG through the labyrinth. Of course, this is anything but an adversarial process, and success is pre-ordained. However, if the requirements imposed by the State of California are not adhered to somewhat scrupulously, the new BID will be vulnerable to challenges by non-mainstream anti-BID malcontents.1 Thus the City has an interest in making sure that these consultants are competent.2

It turns out that they take this interest seriously enough that the City Clerk maintains a list of qualified BID consultants. I recently obtained a copy from 2010. There are some old friends on there, e.g. Donald Duckworth, who you might recognize from 2014 as the initial consultant on Mike Bonin’s Venice Beach BID project, since replaced by the shadowy ringlet-tossing Tara Devine. The famed Susan Levi is also on that list. But all things must pass away, and the list will eventually need to be renewed. Thus it seems that in August 2015 the Clerk put out a request for qualifications seeking new qualified consultants to put on the list.3 So now it is possible to tell exactly what skills you need to develop if you want to be a shadowy BID consultant too!
