A Brief Discussion Of How Homeless Encampment Sweeps Are Scheduled In The City Of Los Angeles — Or At Least Part Of The Process — The Whole Thing Is Driven By Housedweller Complaints — Filtered Through Council Districts As Political Patronage — LAHSA Involvement — Every Kind Of Outreach — Is Basically A Cover For Relocation — The Only Actual Goal

A couple days ago it came out on Twitter that a lot of people in Los Angeles don’t understand how homeless encampment sweeps get scheduled and why, in particular how encampments to be swept are chosen. I promised to write a post about it, and here we are!1 Part of the reason for the delay is that the story is really complex, so I’m just going to talk qualitatively about how encampments end up being targeted by Council Districts and leave the rest for another post or two.2 For instance, the City has two kinds of sweep teams, which are CARE and CARE+, but I’m not going to talk about the differences,3 which are probably important, but not for this post.

Each Council Office has a staffer whose job is to work out their District’s sweep schedule with LA Sanitation. I think that ordinarily every request for a sweep in a given District goes through this San contact.4 The scheduling is done by email as well as by editing Google Docs, and the emails occasionally reveal the reason a given encampment is being targeted. Here are the sets of records this post is mostly5 based on. If you’re interested in the subject it’s really worth looking at these. There’s a lot more information there than I’m using here:

Over the last few days I’ve received a few massive releases of records from Los Angeles Sanitation about homeless encampment sweep authorizations. There’s far, far too much information here for one post but I want to get links published because the information is essential. The records illuminate a number of important issues, not least of which has to do with the sweep selection process.1

For the most part encampments to be swept are chosen by Council District offices, who make selections based on complaints from property owners and probably other reasons too. These records reveal something I hadn’t seen before, though, which is that on its own initiative LAPD can also select encampments to be swept. Here are links to the new material, followed by a story or two gleaned from it.

Here’s another installment in my ongoing series of posts about the City of Los Angeles and the interesting ways in which its various departments violate the California Public Records Act.1 Today I’m looking once again at Los Angeles City Council District 13, repped by the fecklessly idiotic troll doll Mitch O’Farrell, and some of O’Farrell’s illegal email redaction policies.2 The story actually begins last March.

At that time I received some emails from CD13 containing conversations between staffers, LAPD officers, and local owners of commercial properties about homelessness. The discussions were filled with dehumanizing stereotypes and calls to starve the homeless, to use pressure-washing and illegal planter placement and other hostile measures to displace them, and so on. All of this not just uncriticized, not just accepted, but actively encouraged and facilitated by City staff and LAPD officers.

I found the whole scene appalling and wrote a number of posts exposing these privilege-addled sociopaths, the main one of which is here but this other one about Kanye West flunky Anthony Kilhoffer is also good. Some of them flipped out and threatened me and apparently others complained to CD13 that I had exposed their sociopathy to the world or that I was mean to them on the internet or whatever. Since then, clearly in response, CD13 has redacted email addresses of basically every correspondent who’s not using a government email address.3

Dan Halden, who’s responsible for handling some of my CD13 CPRA requests,4 has told me that such redactions are legally justified because exposing constituents to personal mockery for advocating genocide against the homeless would create a chilling effect on their willingness to contact their elected officials. Here’s one instance of Halden’s articulation of this novel5 legal theory:

City Of Los Angeles Sued Yet Again To Enforce Compliance With The California Public Records Act – This Time Over Emails Concerning Various Matters Of Public Concern – Garcetti/Repenning/Morrison Conspiracy Against Selma Park – Wesson Corruption – Huizar Corruption – Less Than Two Weeks After Filing They Already Conceded Fault And Are Producing Documents – This Is No Way To Run A Damn City

I’m a little late in writing this up, but on December 9, with the able assistance of Abenicio Cisneros and Joseph Wangler I filed yet another petition under the California Public Records Act seeking to compel the City to follow the damn law and hand over a bunch of records I had asked for ever so long ago. And as they often will do, they actually started handing them over immediately, although I haven’t gotten the most interesting ones yet.

The petition covers three major requests,1 unrelated other than by the fact that they were all made to the City’s Information Technology Agency. These are the folks to file CPRA requests for emails with if you want MBOX format, which ultimately is the best way to get emails.2 ITA is also the sole source for emails in the accounts of former City employees. Here’s a link to the very interesting petition, worth reading for many reasons and also containing every last detail of the requests at issue, described more briefly below.

First is a request I first made in 20163 for emails having to do with Eric Garcetti when he was repping CD13, his staffers Heather Repenning and Helen Leung, and their conspiracy with Kerry Morrison, then-commander of the Hollywood Entertainment District BID, to illegally exclude homeless people from Selma Park in Hollywood.

Whiny Baby Mitch O’Farrell Barred Activists Doug Haines And George Abrahams From One Of His Damn Planning Meetings In 2014 – In Fact His Then Planning Deputy – Self-Confessed Criminal Marie Rumsey – Physically Pushed Them Out Of The Room – All Because They Were Litigious And Had Criticized O’Farrell – They Sued And After A Circuitous Process Their Suit Was Dismissed – They Appealed And Last Week The Appellate Court Reversed The Dismissal – Which Among Other Things Seems To Mean That If All The Facts The Plaintiffs Allege Are True Then They Would Win – And This Might Mean Maybe Mitch At Some Point Could Have To Open The Damn Meetings? – Anyway Get A Copy Of The Ruling Here And See If You Can Figure It Out!

Mitch O’Farrell, the crying-little-babiest Councilmember in the whole City of Los Angeles, was soundly rebuked in his whiny ways by the California Court of Appeals, which last week issued an opinion reversing Superior Court Judge Elizabeth Allen White‘s dismissal of a lawsuit brought by the Beachwood Canyon Neighborhood Association against the City.1

The dispute was over a planning meeting sponsored by CD13 in 2014, from which Hollywood activists George Abrahams and Doug Haines of the Association were physically barred by then-CD13 director of planning (and self-confessed criminal) Marie Rumsey. As the ruling summarized the story:

Petitioners alleged that on June 26, 2014, [a Hollywood Design Review Committee] meeting was held at the office of Lehrer Architects “to discuss various projects proposed for Hollywood.” Abrahams and other members of the public went to the meeting location, but “were denied entry to the building.” Haines was also denied access, but he entered the room anyway. When Haines picked up a copy of the meeting agenda from a table, Marie Rumsey, planning deputy for CD13, “pulled the agenda from his hand and physically shoved him toward the exit.” Meanwhile, “Abrahams observed groups of lobbyists entering the building at will.”

So the Association argued that the meeting was subject to the Brown Act and that their exclusion violated that law. Furthermore, they argued that O’Farrell had exluded them based on the fact that they disagreed with his positions on various issues, which violated the First Amendment:

Petitioners also alleged that on January 15, 2015, O’Farrell said that people who tried to “crash” HDRC meetings in the past would not be allowed to attend future meetings. Petitioners alleged that O’Farrell was “singling them out because of positions they have previously taken on matters of public concern, and because they have previously been involved in litigation against the City of Los Angeles.”

O’Farrell’s position was that the meeting was private, was not subject to the Brown Act, and that therefore he could exclude anyone he wanted to. The case went through a number of highly technical twists and directions, very few of which I understand well enough even to summarize, and finally, in December 2017, Judge White declared a nonsuit, which I guess is essentially a dismissal of some kind, and it’s that declaration that was appealed here and reversed by the Appellate court.

Huge Release Of City Of Los Angeles Homeless Encampment Sweep Scheduling Emails Reveals Crucial Steps Of Planning Process — Including Scouting Reports — Time Estimates — Daily Schedules — Notice Posting — Obtained From LAHSA — This Is Essential And Fundamental Primary Source Material For Understanding The Encampment Sweep Scheduling Process — And Another Incremental Step Toward The Years-Long Struggle To Make Sweep Schedules Public

One of the most egregious ways in which the City of Los Angeles terrorizes and oppresses homeless human beings is with so-called encampment sweeps, in which City officials, guarded by police, swoop in and confiscate and dispose of people’s possessions, including in many cases life-essential materials such as medicine, official papers, tools, tents, bicycles, and so on.

This appalling practice has inspired a long chain of successful federal lawsuits against the City, the most recent one of which1 was filed on July 18, 2019.2 Human rights activists, for instance to name just a couple Streetwatch and Services Not Sweeps, have been trying for years to get advance notice of sweeps for many purposes, not least among which are monitoring and outreach to the victims.

Since 2016 I have also been trying to get the City to cough up advance notice via the California Public Records Act. I had one early success, thus proving that the concept at least could work, but since then the City has mostly ignored me. And even on one occasion worse than ignored me, they illegally denied me entry into the Public Works Building, thus preventing me from seeing advance schedules.3 I wrote about my progress a couple more times, once in October 2016 and again in November of that year. There haven’t been enough new developments since then for a post,4 until today, that is.

One of the key strategies in public records activism is making requests for the same materials from every possible agency that might hold records. This increases the odds of getting a complete set of responsive material in the face of obstruction.5 I have been working on getting access to sweep scheduling materials through LA Sanitation, who has ignored me since 2017, through LAPD, which is slightly better but still routinely takes up to a year to produce material, through various Council offices, the office of the Mayor, and so on.

But for some reason it never occurred to me before May 2019 to request records from the Los Angeles Homeless Services Authority, which is also deeply implicated in the process of planning and carrying out sweeps. But request them then I did, and last week they released about 5% of a promised 16GB6 collection of emails between LAHSA operatives involved with sweeps and various complicit parties at the City of Los Angeles, and you can get your copies here on Archive.Org.

In Which Demented Grammy-Winning Housedwelling Psychopath Anthony Kilhoffer Wants Us To Know That We Are “In Violation Of Defamation Of Character” For Calling Him A Psychopath — And Blah Blah Blah Lawyers Blah Blah Blah Demands Blah Blah Blah Shit Bags Blah Blah Blah — And We’re Used To That Kind Of Blustery Crapola From Our Friends And Subjects — Especially The Psychopathic Ones — But Dude Doesn’t Like Our Cartoons?!? — That Really Hurts!

Oh Lord! Remember a few weeks ago when we published some demented rants by mouth-frother and crazed homeless-hating Hollywood capitalist Anthony Kilhoffer? The point of which was that it doesn’t matter how absolutely incoherently dementedly psychopathic are the rants of homeless-hating housedwellers, City officials will nevertheless treat them with the utmost consideration, greet them, meet them, respect them, call in sweeps and displace suffering homeless human beings merely to placate them in their unreasoning rage, and so on.

But homeless-hating housedwelling psychopaths are not generally very perceptive, thoughtful, aware of things outside their heads, and so on. And why should they be given that they can get whatever it is they want through blind rage? On the basis of this theoretical framework, then, it makes perfect sense that Kilhoffer, on discovering my publication of his publicly available rage rants, wouldn’t reflect on the fact that he chose to display his psychopathy in public, but would instead choose to call me a bunch of mean names and then threaten me with legal action?

And that’s just what he did! With A WHOLE LOT OF CAPITAL LETTERS!!! And you can read the two emails here and here, and of course, there are transcriptions below! Stay tuned for more news as we get it!

For about two months now I’ve been looking into the practice of Twitter users being blocked or muted by official City of Los Angeles accounts. I’m still gathering evidence, but yesterday it came out that Police Commission president Steve Soboroff blocks a bunch of users who’ve never even interacted with him, so I thought it’d be timely to write up the information I have so far. This issue is of special interest in these latter days given that in 2018 a federal judge ruled that it is unconstitutional for Donald Trump to block users on Twitter.

What I can offer you today, friends, is Twitter block/mute information for eleven of the fifteen council districts, the City Attorney, the Mayor, and a small selection of official LAPD accounts.1 There’s also an interesting line of hypothetical bullshit from deputy city attorney Strefan Fauble2 about some pretty technical claims about CPRA exemptionism,3 but that, being übernerdlich, is way at the end of the post.

Most of the accounts blocked are porn or spam, but Jose Huizar and David Ryu are notable exceptions. Both reps block accounts that are obviously controlled by actual individual people. Huizar’s list is by far the most extensive, and includes wildly inappropriate blocks like @oscartaracena and @BHJesse.

My research on this question is ongoing, mostly hindered by the City of LA’s familiar foot-dragging CPRA methodology. Turn the page for a tabular summary of the results I have so far along with a brief discussion of how Strefan Fauble is still on his CPRA bullshit.

In 2018 LAPD Hollywood Division Senior Lead Officer Paul Jordan Threatened A Homeless Man — Intimidated Him Into Moving To Another Neighborhood — To Please A Mob Of Angry Delusional Homeowners — Who Along With The LAPD Characteristically Think That A Bunch Of Crap They Just Made Up Is More Important Than People’s Actual Lives — And Dan Halden — Mitch O’Farrell’s Hollywood Field Flunky — And David Ryu Flunkies Catherine Landers And Rachel Fox — And Deputy City Attorney Steve Houchin — And Hollywood Division Chief Boss Cory Palka — All Of Them Read Jordan’s Account Of This Threat — And Were Silent

I just received a reasonably large set of emails from the LAPD involving Hollywood zillionaire, racist police-caller, and Hollywood Media District BIDdie Ferris Wehbe1 and LAPD Hollywood Division Senior Lead Officer Paul Jordan. I was looking for material involving the Hollywood Forever Cemetery fiasco but ended up with a bunch more evidence about what the LAPD motto means with respect to our homeless brothers and sisters when the cops think no one is watching but the hateful homedwellers to the whims of whom they’re paid to pander.

You’ll find a lot of interesting stuff in there, but the text for today’s sermon is this conversation from February and March 2018. The participants are the usual rageball gang of housedwellers, possessed with the usual heaping dose of what passes for righteous wrath among the propertied classes, Hollywood cop Jordan, and various City staffers, including Mitch O’Farrell flunky Dan Halden, a couple of jokers from CD4, deputy city attorney and, at that time, Hollywood neighborhood prosecutor Steve Houchin, and Hollywood Division Commander Cory Palka.

There’s really nothing atypical about the story. It begins, as so many of these episodes do, with an imaginary claim that things are getting worse, that the median melanin level in a previously placid caucasian paradise is rising, crime is exploding, turpitude is raining down like the mighty waters, and so on. The florid semiliteracy of this initial cri de coeur, though, is kind of unique and so is presented here with the weirdo capitalization, made-up words, and idiosyncratic spelling all intact, is not standard:

Seems Like there’s this sergeancy of Brazen Homeless youth and some older that are wondering around the De Longpre Park neighborhood looking for Crimes of Opportunity!

The fear and anger and hate escalate through familiar delusional stages albeit with uniquely weird particular details. Homeless people are shitting in the bushes! They’re naked in the driveway and showering with the hose! They’re having sex on the lawn! At eleven in the morning! The church attracts them by handing out free food! The 7-11 attracts them by selling hot food!

They’re drinking beer! They’re making people nervous! They’re setting up tents in permit parking neighborhoods, which everyone knows is not allowed!2 They don’t pay property taxes! And bills! Like normal people! We need to form armed vigilante gangs! Like we had in the good old days! Let’s have a neighborhood meeting!3

And eventually they focus their rage on one particular tent, although it’s certainly not clear that the person living there has had anything to do with the enumerated atrocities.4 And in one of the most explicitly articulate statements of official City policy towards the homeless we’re likely to see, Hollywood Division Senior Lead Officer Paul Jordan explains what happened next:

On Feb 21, 2018, at 3:46 PM, Paul P Jordan <32285@lapd.online> wrote:

Hi Judy,

I had a nice conversation with the young man inside the tent today. Needless to say, his tent is gone and he will not be returning to that location. I also went to the LGBT Center and spoke with Andrew, who is now aware of this individual, and will be spoken to by the LGBT staff. Please keep me posted if he decides to return.

PJ

And then? Well, Officer Jordan gets the immediate gush of goopy approval that such thuggie boys live for5 and the very next day David Ryu flunky Catherine Landers is back to discussing the terms of the upcoming neighborhood meeting. There’s no outrage from these City staffers, no note to Paul Jordan telling him that it’s against the law for police to go around threatening homeless people to get them to move, no nothing.

And no surprise from me, either, because I’ve just read too many emails exactly like these ones to be surprised anymore. But I’m still mad that this is the level our City government is at, that not only do they break the law and oppress the poor to placate the rich but they don’t even try to hide it. Turn the page for a transcription of the conversation.

Newly Obtained 2016 Emails Show That Senior Assistant City Attorney Valerie Flores And Chief Assistant City Attorney David Michaelson Agreed With This Blog That Banning Adults Without Children From Selma Park Was Illegal — Even As Flores Caustically Blamed Rec And Parks For Removing Signs She Had Tacitly Admitted Should Have Been Removed — No Matter What Kerry Morrison, Eric Garcetti, And Mitch O’Farrell Said About It — Further Evidence Linking O’Farrell’s Universally Mocked 2016 Proposal To Ban Adults From City Parks With Reopening Of Selma Park — Also New Info On The Content Of Mitch O’Farrell’s Feverish Delusions About Drug Dealers Overrunning The Largely Vacant Real Estate In His Head

OK, brief recap1 on the situation with Selma Park in Hollywood! In September 2015 I discovered that the Hollywood Entertainment District BID had illegally placed signs on the outer fence of the Park stating that adults without children were banned and in October 2015 Rec and Parks removed the illegal signs. Morrison engineered this years-long illegal exclusion of the people of Los Angeles from their public park because, despite her stridently self-proclaimed Christianity, she was angry that people were using the park to share food with one another.

Subsequent investigations showed that dozens of people had been arrested in the park for violating these illegal restrictions, although none were prosecuted and that current school board candidate and former Public Works Commissioner Heather Repenning, at that time a staffer for Eric Garcetti back when he was repping CD13, was deeply involved with Kerry Morrison, the BID’s very own Ilse Koch, in the illegal park closure process.

Documents proved that Morrison’s gestapo wannabes, the Andrews International BID Patrol, had been deeply involved in the ongoing series of civil rights violations engendered by the illegal park closure, not only by chasing people out of the park who had every right to be there, but by making actual custodial arrests as well, contrary to Morrison’s vehement but mendacious denial that this had ever occurred.

Subsequently, in December 2016, Mitch O’Farrell introduced a motion in Council seeking to amend the Los Angeles Municipal Code to allow the City to ban adults without children from playgrounds in LA Parks. He linked this explicitly to the reopening of Selma Park. This crapola motion was supported by Kerry Morrison, whose idea it must have been, but universally mocked and opposed by all sane people in Los Angeles and some not so sane ones as well. Even people who live east of San Bernardino took some notice of O’Farrell’s incipient crackpot fascism. And thus did the proposal die in committee in December 2018.

And just recently I received a massive set of emails between people at RAP and Mitch O’Farrell’s Hollywood field deputy Daniel Halden.2 And buried amonst them was this lengthy email conversation from November 2016 between various folks at RAP, Daniel Halden of CD13, and Valerie Flores and David Michaelson of the City Attorney’s office discussing Selma Park, those illegal signs, this blog, and, interestingly enough, me, who, like the bloody-handed henchman she is, Flores calls “a serial CPRA abuser.”3

And interestingly enough, more than a year after the signs came down, Valerie Flores tells RAP to put the signs back up, but only on the playground, not on the park itself. Which is pretty ridiculous, since they never took the signs down from the playground and no one, to my knowledge, ever complained about the signs on the playground. The discussion even escalated to Chief Assistant City Attorney David Michaelson, who also stated definitively that the City could not ban adults from the entire park, but only the playground.

Given that they’re falling over themselves here to admit that I was right all along about the damn signs, you’d think that instead of calling me names these people might have been grateful to me for merely calling attention, rather than leaving them to get sued, to the fact that in the City’s nauseating eagerness to do whatever random crapola Kerry Morrison demanded of them, they’d been violating people’s civil rights for a freaking decade4 by arresting them for being in a park they had every right to be in.

Also interesting is the fact that Flores quoted Mitch O’Farrell on the reason for the signs going back up:5 “According to the Council Member, after the sign was removed, the Selma Park became overrun with drug dealers and other criminal elements.” If you know the area, you’ll know this is a lie. You’ll also suspect that Mitch O’Farrell has never been near that park in his life and that the lie was almost certainly put into his mouth by Kerry Morrison.

And, shedding some light on the genesis of the universally mocked CF 16-1456, Flores announces that “Next week we will work with RAP to discuss options for the area of Selma Park that does not include the children’s play area.” Of course, by now it’s clear that there are no such options or they would have banned everyone but the damn cops from that poor beleaguered little park by now. The whole conversation is very, very much worth your time, and if you turn the page you’ll find a transcription, reordered chronologically for ease of reading.
