Hearing on Plaintiffs’ Application for Contempt and Sanctions Set for March 21, 11 a.m.

California-centralMagistrate Judge Andrew J. Wisterich has filed an order setting a hearing on plaintiffs’ application for contempt and sanctions, to be held March 21, 2016 at 11 a.m. in room 690 of the Roybal Courthouse. The City is also ordered to get those discovery materials in soonest. Ominously for the City, Judge Wisterich also ordered the plaintiffs’ to prepare a statement of the fees they’re seeking for dealing with the City’s recalcitrance. ORDER REGARDING PLAINTIFFS’ EX PARTE APPLICATION FOR CONTEMPT AND SANCTIONS, ETC.

The court has considered plaintiffs’ ex parte application and defendant City of Los Angeles’s opposition thereto. The ex parte application is granted in part and denied in part. Plaintiffs’ ex parte application for contempt or other sanctions is scheduled for hearing on March 21, 2016, at 11:00 a.m. Defendant City of Los Angeles is directed to complete its production of documents no later than March 11, 2016. Non-compliance may result in the imposition of monetary sanctions, contempt sanctions, issue preclusion, or entry of judgment by default. Further delay is simply not acceptable. Plaintiffs shall file a reply in support of their application to inform the court of the current status of discovery on March 16, 2016. Plaintiffs shall file with their reply an updated statement of the total amount of attorneys fees and expenses sought in respect of their efforts to obtain defendant City’s compliance with its discovery obligations.
